Vapes-Bars Limited said they have reached an amicable agreement with iMiracle (HK) Limited and Green Fun Alliance Limited to settle their dispute, putting an end to the conflict on the trademarks Found Mary and Lost Mary.
Both parties will continue to separately innovate their respective products. Vapes-Bars will soon introduce its new products under the ANGEL brand. The terms of the settlement remain confidential between the parties.
It was reported in September last year that Vapes Bars Limited had “firmly” refuted the accusations of trademark infringement and passing off against its Found Mary disposable vape brand.
The legal action was initiated by iMiracle (HK) Limited, which owns the disposable vape brand Lost Mary, and UK-based wholesaler Green Fun Alliances Limited. iMiracle also owns the leading disposable vape brand Elfbar. The claim made by iMiracle UK stated Found Mary copied elements of Lost Mary’s design, brand and name. If successful, Vape Bars could be forced to remove its current Found Mary versions from sale.
Vape Bars “firmly refuted” the claims in its defence filed on Sept 7 2023, alleging there are “substantial differences” between the brands, and ‘Mary’ is too common in vape names to be protected. Vapes Bars said it has filed a comprehensive defense against the claims brought forth by iMiracle.
Earlier Vapes Bars introduced the Vapes Bars Found Mary 600 range, featuring 18 flavours. The company asserted that the “design elements and colour schemes used are well-established within the industry and devoid of any distinctive character,” and refuted the claims of trademark infringement contending that the marks ‘Lost Mary’ and ‘Vapes Bars Found Mary 600’ are “significantly different”.
